Greene County district court, week ending Sept. 4

In Greene County district court Adam Joseph Harvey, 44, of Grand Junction was sentenced Sept. 3 to one year in jail after he changed his plea to guilty to a charge of possession of methamphetamine. In the same case, Harvey was sentenced to 180 days in jail on a charge of possession of marijuana. Both jail terms were suspended and he was placed on probation to Boone/Greene County Probation for two years. He must undergo a substance abuse evaluation and complete any recommended treatment at his own expense. He was fined $315 with a $47.25 surcharge on each count. He must pay $207.90 restitution for his court appointed attorney’s fees. (The case was initiated in January 2020.

In a separate case initiated against Harvey, initiated in May 2020, he was sentenced to one year in jail on a charge of possession of methamphetamine. The jail term was suspended. He was fined $315 with a $47.25 surcharge. He must pay $214.20 restitution for his court appointed attorneys fees. A charge of possession of marijuana was dismissed. Court costs were $2144. Harvey has requested a hearing to determine his ability to pay restitution for his attorney’s fee and court costs. A companion case in magistrate court in which Harvey was charged with possession of drug paraphernalia was dismissed. (Sentencing: Honorable Joseph B. McCarville)

Candice Marie Ortiz, 32, of Grand Junction was sentenced to one year in jail after she changed her plea to guilty to a charge of driving while license barred. All but two days of the jail time was suspended, and she will receive credit for time served. She was fined $1,250 with a $187.50 surcharge; one-half will be waived if she obtains a temporary restricted license. Ortiz was sentenced to 10 days in jail on a charge of operating while intoxicated. The jail terms are concurrent, but consecutive to jail time in another Greene County case. She will receive credit for time already served. She will be on informal probation to the Greene County sheriff’s office for one year, Ortiz may complete the Des Moines Area Community College 48-hour alcohol education program in lieu of two days of the jail time. She must also complete a community college drinking driver’s school, and she must undergo a substance abuse evaluation and complete any recommended treatment at her own expense. She was fined $625 with a $218.75 surcharge; one-half was suspended. Ortiz must pay $175 court costs and $425 restitution for her court appointed attorney’s fees. (Sentencing: McCarville)

Devin Julian Villalobos, 19, of Jefferson was sentenced Sept. 3 to two years in jail after he pleaded guilty to indecent contact with a child, amended from sex abuse- third degree. The jail time was suspended and he was placed on probation to the Iowa Department of Correctional Services for two years. On a second count of indecent contact with a child Villalobos was sentenced to 180 days in jail; the jail terms are consecutive. The shorter jail term was not suspended. On each of the counts he was fined $625 with a $93.75 surcharge. He must also pay a $90 sex abuse surcharge on one count. He shall be on the Iowa sex offender registry for 10 years. Yasday Sorter, 29, of Des Moines was sentenced Aug. 31 to 10 years in prison after she pleaded guilty to a charge of burglary- second degree. The sentence is concurrent to a sentence on another Greene County case and two Polk County cases. The prison term was suspended and she was place on probation to the Iowa Department of Correctional Services for three years. She was fined $1,000 with a $150 surcharge. She must pay $1,632 victim restitution. Court costs were $450.93. A charge of theft- second degree was dismissed. (Sentencing: Honorable Thomas J. Bice)

David Hoyle, 35, of Churdan was sentenced to 10 days in jail after he pleaded guilty to a charge of assault- simple, amended from assault while display dangerous weapon. The jail term is consecutive to the term in another Greene County case. Hoyle was fined $315 with a $47.25 surcharge. Court costs were $305. (Sentencing: McCarville)

Persons pleaded not guilty at arraignment as follows: Ryan Douglas Patterson, 39, of Jefferson, assault while display dangerous weapon and leave scene of personal injury accident; James Kenneth Harris, 33, of Woodward, domestic abuse assault- third or subsequent offense; Dakota Bradley Barrett, 20, of Dayton, theft- third degree (two counts); Kaleb Lee Lentz, 26, of Scranton, driving while license revoked; and Marlene Eleanor Anderson, 50, of Jefferson, driving while license barred. Harris’ trial date was set for Dec. 8. Trial dates for the other defendants listed were set for Nov. 3.

Information is available since the return of an arrest warrant that Jody Lyn Schad, 45, of Jefferson was charged with driving while license barred. The warrant was issued June 12 and returned Aug. 25.

Cases were initiated in district court during the week ending Sept. 3 as follows: Marlene Eleanor Anderson, 50, of Jefferson, driving while license barred; and Chanze Jay Bushman, 19, of Scranton, child endangerment.
